When I removed everyone from my hib guild and tried to recreate it on Alb, the name was still taken.
1. Create Guild
2. Remove all members
3. Try to recreate it
You should immediately be able to make a guild of the same name once the original is disbanded.
It may or may not work like this on live, but this is not a core mechanic or class balance issue.
